END-USER LICENSE AGREEMENT and PRIVACY POLICY

IMPORTANT: THIS END USER LICENSE AGREEMENT (EULA) IS A LEGAL AGREEMENT BETWEEN YOU AND THIS APPLICATION OWNER FOR THE APPLICATION SOFTWARE, CONTENTS , DOCUMENTATIONS, THIRD PARTY USED FOR THIS APPLICATION. READ THIS EULA CAREFULLY. IF YOU DO NOT ACCEPT THE TERMS OF THIS EULA, PLEASE DO NOT INSTALL, COPY OR USE THE SOFTWARE. THIS MIGHT CHANGE IN UPGRADE AND FUTURE RELEASES WITHOUT NOTICE. THIS IS SUBJECT TO CHANGE BASED ON THE EVOLUTIONS OF OUR PRODUCTS. PLEASE KEEP CHECKING PERIODICALLY FOR ANY UPDATE. AGREEMENT

1. Definition

Following definitions are not the exhaustive list of the terms used in the agreement. Certain terms w needs to be interpreted in this agreement, the way it is defined in this section.

1. Owner: Owner of this software application is Chinmoyee Dash.
2. Third Party: Third Party means the third party software being used in the software development.
3. Customer or User: Customer or User means the individual who is using the software.
4. Single User: Single user means the individual human who is going to use this software. If a person in an organization is using this application, they cannot keep transferring to different individual or share the same application in a single device with multiple persons.
5. QShelf: QShelf in this agreement means the alias name for QShelf applications developed by Owner e.g. Biology X ICSE QShelf ("Software").
6. QShelf^® is the registered trademark of Chinmoyee Dash.

2. Software License 2.1 License Grant.

Subject to the terms and conditions of this Agreement, Owner grants to User a non-exclusive, nontransferable, limited license, without right to sub-license, to use QShelf Application in accordance with this Agreement and any other written agreement with Owner.

2.2 License Software Use Restrictions.

1. This cannot be used for commercial purpose unless there is a separate agreement with owner for any commercial use. Owner does not transfer the title of the application to you; the license granted to you is not a sale.
2. This is can be used for a single user.
3. You shall use QShelf application in compliance with all applicable laws and not for any unlawful purpose. Without limiting the foregoing use, display or distribution of QShelf Application together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, sexual orientation or age is strictly prohibited. Owner is not responsible for the types of contents created by user using this application.
4. This software is licensed, not sold and owner reserves all rights to the software.
1. Unless Owner has authorized you to distribute the Software, you shall not make or distribute copies of the Software or transfer the Software from one device to another. You shall not decompile, reverse engineer, disassemble, include in other software, or translate the Software, or use the Software for any commercial purposes. You shall not modify, alter, change or otherwise make any modification to the Software or create derivative works based upon the Software. You shall not rent, lease, resell, sub-license, assign, distribute or otherwise transfer the Software or this license.
2. Use the Services in any unauthorized way that could interfere with anyone else's use of them or gain access to any service, data, account, or network; enable access to the Services or modify any owner-authorized device (owner's device etc.) by unauthorized third-party applications.
5. Ownership
   This license provides you with limited rights to use the Software. The Owner retains all ownership, right, title and interest in, to and of the Software and all copies of it. All rights not specifically granted in this license, including domestic and international copyrights, are reserved by the Owner.
6. Copyright Restriction
   This Software contains copyrighted material, trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile QShelf Application. Nor can you create any derivative works or other works that are based upon or derived from QShelf application in whole or in part. QShelf name, logo and graphics file that represents QShelf Applications shall not be used in any way to promote products developed with this QShelf Application . Owner retains sole and exclusive ownership of all right, title and interest in and to QShelf Application and all Intellectual Property rights relating thereto. Copyright law and international copyright treaty provisions protect all parts of QShelf Application , products and services. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for owner.
7. Limitation of Responsibility
   You will indemnify, hold harmless, and defend owner, its employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of QShelf Software. In no event (including, without limitation, in the event of negligence) will Owner , its employees, agents or distributors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, QShelf Application or the use or inability to use QShelf Application or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence.
8. Support and Maintenance
   Owner is not liable to provide the support. Owner might enhance the software and notify the user regarding upgradation. Owner is not liable to support all future versions of OS in which it is installed.
9. Consent for User data collection and Privacy policy
   
   1. You agree that Owner may collect and use information gathered in any manner as part of the product support services provided to you, if any, related to QShelf Applications
   2. Owner may also use this information to provide notices to you which may be of use or interest to you.
   3. Owner may use the collected information for software licensing purpose
   4. QShelf might use the email id provided to communicate the user defined email id with user's responsibility.
   5. Owner will not share the user's email id to any third party other than communication related to QShelf applications.
10. Advertisement Policy for Children
    Free users of the Applications contains advertisement. Owner has defined the possible filters to exclude the objectionable promotions for the applications used by children. We request parents to keep a watch on promotions and report to us in email id foneineed.qshelf@gmail.com for any objectionable promotions so that we can take the desired actions to filter it.
11. DISCLAIMER OF WARRANTY
    VENDOR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. VENDOR DOES NOT WARRANT THAT THE PRODUCTS WILL MEET CUSTOMER'S REQUIREMENTS, THAT THE LICENSED SOFTWARE IS COMPATIBLE WITH ANY PARTICULAR HARDWARE OR SOFTWARE PLATFORM, OR THAT THE OPERATION OF THE LICENSED SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE LICENSED SOFTWARE WILL BE CORRECTED. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE LICENSED SOFTWARE IS ASSUMED BY CUSTOMER. FURTHERMORE, VENDOR DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING THE USE OR THE RESULTS OF THE USE OF THE LICENSED SOFTWARE OR RELATED DOCUMENTATION IN TERMS OF THEIR CORRECTNESS, ACCURACY, QUALITY, RELIABILITY, APPROPRIATENESS FOR A PARTICULAR TASK OR APPLICATION, CURRENTNESS, OR OTHERWISE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY VENDOR OR VENDOR'S AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF WARRANTIES PROVIDED IN THIS AGREEMENT.
12. Limitation of Liability.
    IN NO EVENT SHALL VENDOR BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, INDIRECT, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF BUSINESS INFORMATION) ARISING OUT OF OR CONNECTED IN ANY WAY WITH USE OF OR INABILITY TO USE THE LICENSED SOFTWARE, OR FOR ANY CLAIM BY ANY OTHER PARTY, EVEN IF VENDOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. VENDOR'S TOTAL LIABILITY TO CUSTOMER FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) SHALL NOT EXCEED THE PURCHASE PRICE. THE LIMITATIONS PROVIDED IN THIS SECTION SHALL APPLY EVEN IF ANY OTHER REMEDIES FAIL OF THEIR ESSENTIAL PURPOSE. ADVERTISEMENT DISPLAYED IN APP ARE 3RD PARTY. THOSE ARE OWNER BY RESPECTIVE OWNERS. QSHELF OWNER IS NOT LIABLE FOT THOSE ADVERTISEMENT.
